Ed Westwick escapes charges on any of the sexual assault claims made against him due to lack of sufficient evidence

Ed Westwick will not be facing charges for the allegations of sexual assault made against him by three women due to insufficiency of evidence.

The Gossip Girl star was accused of rape by two women and sexual assault by a third last November. The first accuser, Kristina Cohen, posted a detail account of Facebook detailing that she fell asleep after a dinner with Westwick one night and woke up with him on top of her. Another woman, Aurélie Wynn, then came forward with her own claims. Both women claimed the assaults had taken place in 2014. The third accuser has remained unnamed.

Westwick completely denied the “unverified and provably untrue” allegations, and wrote on Instagram, “I have never forced myself in any manner, on any woman. I certainly have never committed rape.” He also said he did not even know the first accuser, Cohen. The Los Angeles District Attorney has now given him a defacto vote of confidence by saying there is not enough evidence against him to pursue a formal lawsuit.

The prosecutors said that the witnesses provided by the two women accusing Westwick of rape were “not able to provide information that would enable the prosecution to prove either incident beyond a reasonable doubt.” The memo also said, “Prosecution on those two incidents is declined due to insufficient evidence.” They were unable to contact the third victim entirely. Other women also came forward to claim that Westwick had touched them inappropriately and without invitation, but prosecutors said these allegations fall outside the statute of limitations and cannot be pursued.

After Westwick was accused last year, he was cut out of BBC’s drama Ordeal by Innocence. In response to this, Westwick tweeted, “It is disheartening and sad to me that as a result of two unverified and probably untrue social media claims, there are some in this environment who could ever conclude that I have had anything to do with such vile and horrific conduct.”

Due to the allegations, shooting of Westwick’s BBC Two show White Gold has also been paused.
